Solidarity Youth Movement: Urgent Need of Independent Investigation Team Under Delhi High Court

The police refuse to receive complaints of victims, if they have mentioned the name of the culprits.

Even after the  four-day long pre-planned genocide executed by the sangh parivar with the help of Delhi police in the regions of Mustafabad, Jafarabad, Chandbagh and Shiv Vihar of the Northeast district of Delhi from February 23, the Delhi police is still continuing its hunt for Muslims. To strengthen the false narrative of the state, focusing on people like the AAP leader Tahir Hussain in the name of violence, the Delhi police consciously tried to propagate that Muslims are behind the violence. The police is arraying hundreds of Muslims as accused, in the crimes registered against ‘unidentified persons’. The victimised Muslims are being accused, arrested and kept in judicial custody, in the cases registered of inciting riot, burning houses and shops, attempt to murder and offenses as per Arms act, by the Delhi police. The young people who have participated in anti CAA protests are consciously being accused in such cases. Some lawyers say that until now, only people victimised in the violence has been accused, arrested and produced in court.

The police refuse to receive complaints of victims, if they have mentioned the name of the culprits. Most of the complaints received by the police from the victims are now drafted in a manner that would not help lead further investigation but would only support compensation claims. And the police did not even register FIR in these complaints. There are no attempts to collect the evidences or to record the testimonies of the victims. The police are even trying to obstruct the efforts of relief workers as well. They are not ready to disclose any details regarding those who are kept in custody without being arrested. The police still continue to arrest the innocent, frames up against them and unjustly keeps them in custody.

There is a pressing need for a strong legal fight against these kinds of illegal actions from the part of Delhi police. Otherwise, there would be a similar situation in Delhi as that in the case of Muzaffarnagar  genocide, where almost all the accused were acquitted after the farce trial.

More than that, there would be a situation that the people who are victimised by this genocide will have to live rest of their lives in jails and courts. In this context, if the investigation charges vested on Delhi police continue this way, the real culprits will remain unpunished and victims of this genocide will face a further toll in their lives.

So, the Delhi police should be held back from investigation with immediate effect and an independent investigation team  must be formed under the monitoring of the court, which should receive fresh complaints from the victims, record their testimonies, collect evidences, and should ensure an accurate and effective investigation.

Solidarity Youth Movement will take lead and cooperate with all individuals, organizations and agencies in this field, who aim at justice for the victims of Delhi pogrom, through  multi-faceted legal fights.
